Privacy Policy

This policy explains what information Instream collects, why we collect it, who we share it with, and the choices and rights you have. It covers our website, our club portal, and the way we communicate with you by email and text.

This Privacy Policy describes how Instream LLC (“Instream,” “we,” “our,” or “us”) treats information collected or provided in connection with your (“you,” “your,” or “user”) use of instreamconnect.com, the Instream Club Portal at app.instreamconnect.com, our social media pages, and any other digital medium we own or operate (collectively, the “Site”). It also applies to Personal Information (defined below) we collect, store, or use when you contact us by email, mail, text, or telephone, and in connection with any products or services we provide (“Services”).

The information in this policy is designed to tell you:

  • what information we collect;
  • why we collect it;
  • how we use it;
  • with whom it may be shared;
  • your privacy rights; and
  • the choices we offer, including how to access and update information.

By accessing or using our Site, you acknowledge this Privacy Policy and our Terms of Use, including our collection, use, and disclosure of Personal Information as described below. This Privacy Policy is not a contract and does not create any legal rights.

What we collect and why

“Personal Information” is any information that can be used to identify you. This policy does not cover data that cannot be used to identify an individual, or pseudonymous or aggregated data.

We get most Personal Information directly from you. If you share information with us about another individual — for example, adding a colleague to your club’s portal account — you confirm that you have the authority or their consent to do so.

Information you give us

  • Inquiries and reservations. When you submit a form on our Site or email us, we collect your name, business or club name, email address, phone number, event or facility details, and whatever you choose to include in your message.
  • Club portal accounts. If your organization uses the Instream Club Portal to monitor its field kits, we collect the account holder’s name, email address, and role, along with sign-in records. Accounts are created by invitation from Instream or from your club’s administrator; the portal does not offer public sign-up.
  • Alert preferences. If you choose to receive text alerts, we collect your mobile number, the alert categories you select, and a record of your consent (including the date and time you gave it).
  • Correspondence. Records of your communications with us, including support requests.

Information about the equipment we operate

To deliver and monitor our Services, we collect operational data from the connectivity equipment we provide — data volume used, signal strength, online and uplink status, session times, equipment and SIM identifiers, and similar network telemetry. This information describes equipment and network performance, not individual people, and we do not inspect, store, or monetize the contents of the traffic that passes over our equipment. Where such data is associated with a named account holder, we treat it as Personal Information under this policy.

Information collected automatically

When you visit the Site we may automatically receive and store the name of the domain and host from which you access the internet, your IP address, device and browser type, referring pages, approximate geographic location, and information about when, how often, and how long you use the Site. We use this to administer the Site, diagnose problems, analyze trends, protect against abuse (including rate-limiting form submissions by IP address), and understand aggregate usage. Our website analytics are privacy-first and do not use cookies to track you across sites; the club portal uses a session cookie that is necessary to keep you signed in. You can control cookies through your browser settings, though blocking them may prevent parts of the Site from working.

Our web servers may collect aggregate log data about visits to different pages. We use that data to improve access to the Site and do not link it to Personal Information. Third-party providers may also collect aggregate log data independently of us.

How we use what we collect

We use Personal Information to respond to your inquiry and prepare quotes; to plan, deliver, monitor, and support our Services; to operate and secure the portal; to send you the alerts and account notices you have asked for; to maintain business records; to research and improve our Services; to exercise and defend legal claims; to comply with legal obligations; and for the other purposes described in this policy.

You can choose not to provide certain information, but that may delay or prevent us from providing our Services to you.

Text messages and mobile information

Instream offers optional text (SMS) alerts to people whose organizations use our Services. These are operational alerts about your organization’s equipment — for example, that a field kit has gone offline or has crossed a data-usage threshold. We do not send marketing or promotional text messages.

No mobile information is sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third party, and are excluded from every category of information described elsewhere in this policy as disclosed to third parties.

The only parties who handle your mobile number are the service providers who deliver the messages on our behalf (our messaging provider and the mobile carriers), and they may use it solely to transmit those messages and for related support and compliance.

How you opt in. Text alerts are off by default. Inside the Instream Club Portal, you select which alert categories you want by text, enter your mobile number, and check a consent box that reads: “I consent to automated text alerts. Reply STOP to cancel, HELP for help. Msg & data rates may apply.” We record the date and time of that consent. There is no keyword opt-in and we never add a number on someone else’s behalf.

How you opt out. Reply STOP to any message to stop receiving texts, or turn text alerts off in your portal settings. Reply HELP for help, or contact us at info@instreamconnect.com. Message frequency varies with your equipment’s activity. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

How we share Personal Information

We do not sell your Personal Information, and we do not share it for cross-context behavioral advertising. In the preceding twelve (12) months, we have not sold any category of Personal Information.

To conduct our business and serve you, we may disclose Personal Information to:

  • Service providers and vendors who work on our behalf — website and application hosting, database hosting, analytics, customer-relationship and email delivery, text-message delivery, equipment management platforms, connectivity carriers, payment and accounting providers, legal counsel, and similar operational support. They are permitted to use the information only to provide services to us.
  • Your organization. If you use the portal as a member of a club, facility, or event organization, your account and alert activity are visible to that organization’s administrators. We scope every account to a single organization; organizations never see one another’s data.
  • Law enforcement, regulators, courts, or other public authorities, to comply with our legal and regulatory obligations, respond to lawful requests, protect our rights, defend against legal claims, or as otherwise required by law.

We also use third-party analytics services on our Site. Information collected may be used in aggregated or anonymized form to evaluate use of the Site, analyze trends, and better understand online activity.

In the event of a merger, acquisition, corporate change, or bankruptcy, we may share or transfer Personal Information as part of a transfer of our assets to the acquiring entity.

Retention, confidentiality, and security

We retain Personal Information for as long as is reasonably necessary for our business operations and to fulfill the purposes described in this policy, as we determine is necessary for business records, and to comply with applicable law.

We restrict access to Personal Information to those who need it to provide Services and conduct our internal operations, and we maintain reasonable physical, electronic, and procedural safeguards. However, the internet and digital information are not absolutely secure, and we cannot promise guaranteed security. If we believe the security of your Personal Information may have been compromised, we will comply with applicable breach-notification requirements and may notify you at the email address you provided.

Children’s privacy

Our Site and Services are directed to the adults who run clubs, facilities, and events — not to children. We do not knowingly collect Personal Information from children under thirteen (13), and the portal is available only to invited adult account holders. Although our Services are used at youth sports events, we do not collect information about the athletes who play at them, and our equipment does not capture, record, or store video, audio, or images of participants.

If you are a parent or guardian and believe a child has provided Personal Information to us, please notify us at info@instreamconnect.com and we will delete it.

Your choices

  • Email. You can unsubscribe from non-essential email using the link in the message or by contacting us. We may still send transactional messages about your account or a booked event.
  • Text. Reply STOP to any alert, or turn text alerts off in your portal settings.
  • Account information. Portal users can view and update their own account details and alert preferences at any time, or ask us to do it. To delete an account, email us at info@instreamconnect.com. We may require confirmation of your identity, and we may retain certain information for legitimate business purposes or as required by law.

Opt-out requests may not be processed immediately. Changes to or deletion of account information may be reflected promptly in the active database while our servers or associated third parties retain previously provided information for a period of time.

Your rights

Depending on where you live, you may have specific rights over your Personal Information. We do not discriminate against anyone for exercising these rights.

Residents of Oregon

Under the Oregon Consumer Privacy Act, you may request confirmation of whether we process your Personal Information; a list of the specific third parties to which we have disclosed Personal Information; a copy of your Personal Information; correction of inaccuracies; and deletion of your Personal Information. You may also opt out of the sale of Personal Information, targeted advertising, and certain profiling — although, as stated above, we do not sell Personal Information or use it for targeted advertising. You may appeal a decision we make about your request by replying to our response or contacting us at the address below; if we deny your appeal, you may complain to the Oregon Department of Justice.

Residents of California

You have the right to request the categories and specific pieces of Personal Information we have collected about you, the categories of sources, the business purposes for collecting or disclosing it, and the categories of third parties to whom we disclosed it; to correct inaccuracies; and to request deletion. Because we do not sell or share Personal Information, there is no need to submit an opt-out request. We will not disclose your Personal Information to third parties for their own direct marketing purposes unless you agree.

Do Not Track: Section 22575 of the California Business & Professions Code requires website operators to disclose whether they honor browser “Do Not Track” settings. Because no uniform standard has been adopted, we do not currently respond to Do Not Track signals. We reserve the right to update our practices and this policy as such standards evolve.

Residents of Nevada

Nevada consumers may submit a verified request directing us not to make any sale of covered information we have collected or will collect, using the contact information below.

Users outside the United States

Our Site is hosted in the United States and our Services are governed by United States law. Your Personal Information will be stored and processed in the United States, where the data-protection laws may not be as comprehensive as those in your country. By using the Services, you consent to that transfer, and to your Personal Information being shared with the third parties described in this policy. Where required, we process Personal Information only with your consent, to fulfill a contract, or to meet a legal obligation, and you may have rights of access, rectification, erasure, restriction, objection, and portability. Where you have given consent, you may withdraw it for processing that has not yet occurred. In the European Union you may also have the right to complain to a supervisory authority.

How to make a request

You must provide enough identifying information for us to verify the request. We reserve the right to verify the identity of anyone making a request, and we will have no liability resulting from false or erroneous requests or from any change or deletion we make in reliance on them.

Changes to this policy

This Privacy Policy applies to all relevant information collected by or provided to us, or to our authorized third-party vendors and partners, as of the effective date above. When we make material changes we will update the effective date and may notify you by email. Your continued use of the Site or Services after that constitutes acknowledgement and acceptance of the changes.
